1. Scope

These Terms & Conditions apply to all purchases and use of our website. By using this website or placing an order, you agree to these terms.

2. Prices and VAT

All prices are listed in EUR.
As Pima Jewelry operates under the Kleinunternehmer rule (§6 Abs.1 Z 27 UStG, Austria), no VAT is charged and no VAT can be deducted.
We reserve the right to change prices, product information, and availability at any time.

3. Orders and Contract Formation

By placing an order, you make an offer to purchase the selected products.
The contract becomes binding once we send an order confirmation by email or when your goods are shipped.
If an item is unavailable after ordering, we will inform you and issue a refund if necessary.

4. Payment

Accepted payment methods: [e.g., Apple/Google Pay, credit/debit card, bank transfer].
Payment is due immediately upon ordering unless otherwise stated.
Orders will be processed only after payment confirmation.

5. Shipping and Delivery

Orders are usually processed within 2–3 business days after payment confirmation.
Shipping costs and estimated delivery times are shown during checkout.
Pima Jewelry is not responsible for delays, losses, or damages caused by postal or courier services.
Currently, we ship within Austria. For future international shipments, customers will be responsible for customs duties or import taxes.

6. Product Descriptions

We make every effort to provide accurate product images and descriptions.
Slight variations in colour, tone, or texture may occur due to lighting or screen differences.

7. Right of Withdrawal (EU Consumers)

Under Austrian and EU consumer protection law, you have the right to withdraw from a purchase made online within 14 days without giving any reason.

The withdrawal period starts the day after you (or a third party designated by you) receive the goods.

To exercise your right of withdrawal, please contact us by email at info@pimajewelry.at and clearly state that you wish to cancel your order.
You may also use the model withdrawal form provided at the end of these Terms & Conditions.

Returned items must be sent back within 14 days after you inform us of your decision to withdraw.
Refunds (including standard shipping costs) will be issued within 14 days after we receive the returned goods or proof of shipment.

Exceptions (items that cannot be returned):

Custom-made or personalized items
For hygiene reasons, pierced jewelry (such as earrings) cannot be returned once the seal or packaging has been opened.

8. Returns

Returns must be sent to: Flurweg 339, 8311 Markt Hartmannsdorf.
Items must be unused, in original condition and packaging.
The customer bears the direct cost of returning goods, unless the product was defective or sent in error.
Refunds will be made using the same payment method used for the original order.

9. Warranty (Gewährleistung)

Under Austrian and EU consumer law, you are entitled to a 2-year warranty for defective goods.

If a product is faulty or not as described, you may request repair, replacement, price reduction, or cancellation of the contract.

This warranty applies in addition to any manufacturer guarantee (if offered).

10. Liability

We are liable for intent and gross negligence.
For slight negligence, liability is limited to foreseeable damages typical for this type of contract.
We are not liable for indirect or consequential damages, unless required by law.
Liability for injury to life, body, or health remains unaffected.

11. Intellectual Property

All images, text, and content on this website are the property of Pima Jewelry.
Use, reproduction, or redistribution of any content without written permission is prohibited.

12. Promotions and Vouchers

Promotions, discount codes, or vouchers are valid only during the specified time period and under the conditions stated at the time of issue.
They cannot be exchanged for cash or applied retroactively.

13. Force Majeure

We are not responsible for delays or non-performance due to circumstances beyond our reasonable control (e.g., natural disasters, strikes, pandemics, postal disruptions, government restrictions).

14. Data Protection (GDPR)

We process personal data in accordance with the EU General Data Protection Regulation (GDPR).
For details on how we collect, store, and use personal data, please refer to our Privacy Policy available on our website.

15. Dispute Resolution

Consumers may contact an EU-recognized consumer arbitration body for dispute resolution.
We are not obliged to participate in alternative dispute resolution, but we aim to find an amicable solution in any case.

16. Governing Law and Jurisdiction

These Terms & Conditions are governed by Austrian law.
For consumer contracts, the mandatory legal consumer protection provisions of your country of residence also apply.
In all other cases, the courts of Austria shall have exclusive jurisdiction.

17. Changes to These Terms

We may update these Terms & Conditions periodically. The version available on our website at the time of your order applies to that order.
